Who this is for: F-1 students on post-completion OPT or STEM OPT who want an employer-sponsored H-1B.

This is a planning guide, not legal advice. Lottery dates, fees, and forms change. Confirm every deadline with your DSO and on USCIS and Study in the States before you file.

Rule watch (F-1 duration of status): DHS published a final rule on July 17, 2026, effective September 15, 2026, that would shorten the post-completion grace period from 60 to 30 days for students admitted after the effective date, shorten the post-program-end OPT filing window from 60 to 30 days, and require Form I-539 for some extensions. A federal court postponed the rule on September 14, 2026, so the current rules described here still apply. Re-check with your DSO before you file.

What this page helps you do

If you are on F-1 Optional Practical Training and your goal is H-1B, you are running two clocks at once:

  1. Your work-authorization clock (OPT EAD, unemployment days, STEM reports, grace period)
  2. The H-1B fiscal-year clock (March registration, spring petition, October 1 start, cap-gap)

Miss either clock and the other one does not save you.

Use this timeline to answer:

  • When should I apply for OPT vs STEM OPT vs H-1B?
  • Can I sit out one lottery, or do I only get one shot?
  • What happens if I win — or lose — while my EAD is about to expire?
  • What is cap-gap, and when does it not apply?

Quick answer: OPT to H-1B timeline

If you… Typical H-1B shot Risk
Graduate May 2026, non-STEM, 12-month OPT One lottery: March 2027 (FY2028, start Oct 1, 2027) Lose the lottery → OPT ends ~mid-2027, then 60-day F-1 grace
Graduate May 2026, STEM degree + E-Verify employer Lotteries in 2027, 2028, and often 2029 STEM reporting (I-983, 6/12/24-month) is easy to miss
Graduate May 2027 First realistic cap lottery is usually March 2028 (FY2029) unless you already have OPT running Do not assume you can enter the March 2027 lottery unless you have qualifying status and an employer ready
OPT ends before the H-1B petition is filed Cap-gap does not apply You cannot “wait until October” on an expired EAD

H-1B fiscal year FY2028 starts October 1, 2027. Registration for that year is expected in early March 2027 (USCIS announces exact dates each winter). FY2027 (start Oct 1, 2026) registration already happened in March 2026.

Two clocks you must track

Clock A — F-1 work authorization

  • Post-completion OPT: up to 12 months of EAD.
  • Unemployment days: 90 on regular OPT.
  • STEM OPT extension: extra 24 months if your degree is on the DHS STEM list, the employer is E-Verify enrolled, and you have an I-983 training plan.
  • STEM unemployment days: 150 total (the extra 60 are only while STEM OPT is in effect).
  • F-1 grace period: 60 days after OPT ends. You may not work in the grace period.
  • DSO / SEVIS: your I-20 must show the correct employer, dates, and STEM remarks. Your DSO is the only person who can recommend OPT in SEVIS.

Clock B — H-1B cap

  • Cap registration: usually a short window in March.
  • Selection: random draw weighted by wage level (since the FY2027 registration; Level I = 1 entry, up to Level IV = 4), beneficiary-centric (one chance per person, even if several employers register you).
  • Petition filing: if selected, the employer files Form I-129 in the spring window USCIS announces.
  • Start date for cap-subject H-1B: October 1 of that fiscal year.
  • Cap-gap: if a cap-subject H-1B petition is filed on time while you are still on valid post-completion OPT, F-1 status and OPT EAD can automatically extend to April 1 of the fiscal year (or your H-1B start date, if that is earlier). Details below — the exceptions matter.

Your employer files H-1B. You cannot self-petition.

Who this timeline assumes

Most readers are:

  • Completing a U.S. bachelor’s, master’s, or PhD
  • Applying for post-completion OPT (not pre-completion / CPT)
  • Targeting a cap-subject H-1B (most private employers)
  • Either non-STEM (12 months) or STEM (up to 36 months)

This page does not replace advice for:

  • Cap-exempt employers (universities, nonprofit research, some affiliated nonprofits)
  • O-1, TN, L-1, E-2, or marriage-based AOS
  • Day-1 CPT programs (those can poison a later H-1B if the DSO/USCIS finds the CPT was not integral to the degree)

Master timeline: May 2026 graduate

This is the most common path. Shift every date if your program end date is December, August, or another month.

Phase 0 — 6 to 12 months before graduation (fall 2025 – winter 2026)

You

  • Confirm your program end date on the I-20.
  • Ask your DSO, in writing, whether your major’s CIP code is on the DHS STEM Designated Degree Program list. Screenshot it.
  • If you need H-1B, prioritize employers that: (1) E-Verify, (2) have sponsored before, (3) will put you on their payroll (not a client-site staffing chain you do not understand).
  • Do not rely on unpaid “internships,” 1099 contracting, or volunteer work that is really a job. Unauthorized employment can block H-1B.

Employer conversation to have now

“I will be on F-1 OPT after graduation. I will need H-1B cap registration in March 2027. Does the company sponsor, and is it E-Verify enrolled?”

If they cannot answer that, they are not an H-1B plan.

Phase 1 — Apply for post-completion OPT (winter–spring 2026)

Window (typical rule): you may file Form I-765 as early as 90 days before your program end date, and you should not wait until after you leave the U.S. Your DSO must first issue an I-20 with the OPT recommendation.

File

  • I-765 (category (c)(3)(B) for post-completion OPT)
  • I-20 with DSO OPT recommendation (signed)
  • Photos, I-94, visa, passport, transcripts / diploma as your school instructs
  • Filing fee (check current USCIS fee schedule — it changes)

Practical tips

  • File early in the 90-day window. OPT EAD wait times swing. You cannot start post-completion OPT work until you have the EAD and you have reached both the EAD start date and your program end date.
  • Ask your DSO how they want the requested OPT start date aligned with your job offer.
  • Keep PDFs of everything. You will need them for STEM OPT and for H-1B.

Phase 2 — OPT starts (summer 2026)

Work rules

  • Work must be related to your major.
  • Report your employer to your DSO within 10 days.
  • Track unemployment days. Every day without qualifying employment counts. At 90 days on regular OPT, you are out of status if you keep accruing.

What “employment” means on OPT (high level)

Paid work for an employer related to your degree is the clean path. Multiple short gigs, unpaid roles, and “founding a startup” are where people accidentally burn unemployment days or create H-1B RFEs later. If the arrangement is unusual, ask the DSO before you start.

H-1B positioning during year 1

  • Non-STEM: this year is your only realistic cap lottery (March 2027). Treat job search as a visa search.
  • STEM: you still want an E-Verify employer by the time you file STEM OPT, even if you later change jobs.

Phase 3 — Decide STEM OPT vs one-shot H-1B (fall 2026 – winter 2027)

If your degree is not STEM

Your planning target is:

  • March 2027 registration
  • Petition spring 2027 if selected
  • Cap-gap through April 1, 2028 at the latest (or until the H-1B start on October 1, 2027, if approved)
  • H-1B start October 1, 2027

If you are not selected, you generally do not get a second lottery on this OPT. Backup options (discuss with counsel, not a blog): cap-exempt job, other nonimmigrant categories if you qualify, leave and consular process later, or a new degree program (expensive, and Day-1 CPT is a red flag).

If your degree is STEM

STEM OPT is how you buy two extra lotteries.

STEM OPT is not automatic:

  • Employer must be in E-Verify.
  • You and the employer complete Form I-983 (training plan).
  • DSO recommends STEM OPT in SEVIS.
  • You file I-765 category (c)(3)(C) before your current OPT EAD expires (you may file up to 90 days before it expires).
  • You may continue working up to 180 days past the old EAD expiry while the STEM extension is pending, if you filed on time (confirm current USCIS rule when you file).

STEM reporting you will actually forget

When What
Start of STEM OPT I-983 signed; DSO has it
Every 6 months Validation report to DSO (employer, address, still employed)
12-month evaluation I-983 self-evaluation, employer sign-off, DSO
24-month evaluation Final I-983 evaluation
10 days Report job loss, job change, address change
New STEM employer New I-983 to the DSO within 10 days of the start; many schools require it before day one

Missing reports can terminate STEM OPT — which also kills cap-gap later.

Phase 4 — H-1B cap registration (expected March 2027)

USCIS usually opens a short electronic registration window in March. Exact dates are posted on USCIS each year — do not guess from last year.

What must be true

  • You have a U.S. employer willing to sponsor.
  • They complete registration in the USCIS system and pay the registration fee (amount changes; use the current USCIS fee).
  • The job is a specialty occupation (generally a role that requires a bachelor’s in a specific field).
  • Beneficiary-centric selection: extra registrations for the same person do not create extra lottery tickets. Fraudulent multiple registrations can tank the case.

What you should prepare for the employer / attorney

  • Passport, I-94, I-20s (all pages), EAD(s)
  • Degree certificates + transcripts (and evaluation if the degree is from outside the U.S.)
  • Resume matching the job’s field
  • STEM OPT I-983 if applicable
  • Exact work location(s) — this drives the LCA wage

Do not

  • Pay a “consultant” to file H-1B for a fake employer
  • Let a staffing company register you without a real job
  • Assume a job title like “analyst” or “consultant” is enough without a degree-field match

Phase 5A — Selected in the lottery (spring 2027)

Selection is not approval. It is permission for the employer to file I-129 in the announced window.

Typical spring sequence

  1. Employer gets LCA (Form ETA-9035) certified by DOL (prevailing wage, location, hours).
  2. Attorney files I-129 with H-1B cap, filing fees, and supporting evidence.
  3. You stay on OPT (or STEM OPT) while it is pending.
  4. If your OPT EAD would expire before October 1 and the petition was properly filed while OPT was valid, cap-gap can extend F-1 status and the EAD through April 1, 2028 (or until the H-1B start date, if earlier).

Cap-gap — the rules people get wrong

Cap-gap generally requires:

  • You are on unexpired post-completion OPT (or already in cap-gap from a timely filed petition), and
  • A cap-subject H-1B petition requesting a change of status is filed (received by USCIS) before OPT ends.

Cap-gap usually does not save you if:

  • OPT already expired and you are only in the 60-day grace period
  • The employer files after the EAD ends
  • The petition is cap-exempt (different rules)
  • You are on CPT, not post-completion OPT
  • The petition is denied, withdrawn, or not filed after selection
  • You travel poorly during cap-gap (see travel section)

Cap-gap is automatic when the conditions are met; you do not file a separate cap-gap form. Your DSO should update SEVIS. Keep the I-129 receipt (I-797C).

Premium processing speeds the I-129 decision. It does not move the October 1 start date for cap-subject new employment.

If USCIS issues an RFE

Common RFEs for F-1 → H-1B:

  • Specialty occupation (job is too generic)
  • Degree does not match the job
  • Employer-employee relationship (third-party / client site)
  • Maintenance of F-1 status (unemployment days, unauthorized work, bad CPT)

Answer with documents, not with panic. Your OPT clock is still running.

Phase 5B — Not selected (April 2027)

Non-STEM

You likely have until your EAD end date, then 60 days. Use that window for:

  • Cap-exempt H-1B search
  • Other status options if you truly qualify
  • Orderly departure

Do not work after the EAD ends. Do not “volunteer” in your old job.

STEM, still on the 24-month extension

You still have later lotteries (March 2028, often March 2029 depending on when STEM started). Your job is to:

  • Stay employed in a qualifying role
  • Keep I-983 and validation reports current
  • Avoid burning the 150 unemployment days
  • Make sure next year’s employer will sponsor

STEM, but your STEM EAD ends summer 2027

Then March 2027 was your last easy shot. Treat it like the non-STEM case unless cap-gap already attached.

Phase 6 — Summer 2027 (cap-gap or not)

Situation Can you work? Until when?
Regular or STEM OPT EAD still valid Yes, under OPT rules EAD end date
Timely filed cap-subject H-1B + OPT was valid at filing Usually yes, cap-gap April 1, 2028, or H-1B start if earlier
OPT ended, only 60-day grace No work End of grace, then leave or other status
H-1B denied during cap-gap Cap-gap ends; talk to DSO/attorney immediately Do not assume remaining OPT

Phase 7 — October 1, 2027 (H-1B start)

If the petition was approved for change of status:

  • You become H-1B on October 1 (or the approval date if later).
  • You work only for the petitioning employer, in the role and location(s) on the LCA.
  • Get the I-797 approval notice and keep a copy of the petition.
  • Ask HR how payroll, I-9, and the new I-94 will be handled.

If the petition was filed for consular notification instead of change of status, you may need to leave and get an H-1B visa stamp before working. The $100,000 payment can apply to consular-notification petitions for people abroad (change of status vs consular processing). That is a different path — confirm with the attorney when they file, not in September.

Alternate calendars

December 2026 graduate

  • File OPT in the 90-day window before the December program end date.
  • OPT often runs ~January 2027 – January 2028.
  • March 2027 lottery is available if you have an employer ready (tight).
  • March 2028 lottery is the comfortable shot if STEM OPT is approved in time.
  • Non-STEM December grads who miss March 2027 have a short remaining OPT for March 2028 — map the EAD end date against cap-gap before you relax.

PhD / late defense

Your program end date is what SEVIS says, not your defense party. OPT timing follows the I-20 end date. If defense slips, the whole H-1B year can slip with it.

Already on STEM OPT in 2026

The FY2027 registration (March 2026) is closed, and USCIS announced on July 17, 2026 that the FY2027 cap was reached with no second lottery. Your next registration is March 2027. Count how many March windows remain before your STEM EAD ends. That number is your remaining lottery inventory.

Month-by-month checklist (May 2026 grad)

Copy this into your calendar.

Jan–Mar 2026
DSO OPT appointment; I-20 recommendation; file I-765; confirm CIP / STEM list.

Apr–Jun 2026
EAD arrives; program ends; start work only when EAD + program end both allow it; report employer to DSO; start unemployment-day count at 0.

Jul–Oct 2026
If STEM: draft I-983 with manager; confirm E-Verify company number; do not wait until month 11.

Nov 2026–Jan 2027
STEM I-765 window opens 90 days before OPT EAD ends. File early. Keep working only as the pending-extension rule allows.

Feb 2027
H-1B docs to attorney; wage level / job description review; confirm work address.

Mar 2027
Registration window. You should see confirmation from the employer that your account was submitted.

Apr–Jun 2027
If selected: LCA + I-129. Save the receipt. Ask DSO about cap-gap / I-20. If not selected: activate backup plan the same week.

Jul–Sep 2027
Cap-gap work if eligible. Avoid international travel unless counsel clears it. Recheck that the petition is still pending or approved.

Oct 1, 2027
H-1B start. New I-9. Do not keep using the OPT EAD as your status story.

Travel during this whole process

Travel is where clean timelines break.

Status Travel risk
OPT, valid EAD, valid I-20 travel signature, job to return to Usually possible; carry EAD + I-20 + job letter
STEM OPT pending High risk; ask DSO/attorney before buying tickets
Cap-gap High risk; cap-gap EAD extension is not the same as a visa stamp
H-1B pending change of status Leaving the U.S. can be treated as abandoning the change of status
H-1B approved, no visa stamp yet You typically cannot re-enter as H-1B without a stamp (Canadian/Mexican exceptions are narrow)

Never travel on an expired I-20 signature. Never assume an airline or CBP officer knows cap-gap.

Documents to keep in one folder

You will hand this folder to an attorney under time pressure.

  • Passport (6+ months validity)
  • All I-20s (including old CPT/OPT pages)
  • I-94 printout
  • F-1 visa stamp page
  • OPT and STEM EADs (front/back)
  • I-765 receipts and approval notices
  • I-983 + evaluations + DSO emails
  • Pay stubs and W-2s (prove you actually worked)
  • Offer letters, job descriptions, E-Verify screenshot
  • Diplomas, transcripts, CIP code
  • Unemployment-day log (dates you were not employed)

Common ways this timeline fails

  1. Filing STEM OPT after the EAD expires. There is no salvage.
  2. Assuming cap-gap works in the 60-day grace period. It generally does not.
  3. 90 / 150 unemployment days silently used up during a “job search.”
  4. I-983 on a shelf while you already started the STEM job.
  5. Employer that “will sponsor” in March but has no attorney and no LCA plan in February.
  6. Client-site / body-shop role that cannot prove employer-employee relationship.
  7. Job title inflation (“software engineer”) with duties that are not specialty occupation.
  8. Day-1 CPT used as a bridge; later H-1B RFE on whether you were a bona fide student.
  9. Working in the grace period after OPT. That is unauthorized employment.
  10. Travel during cap-gap or pending COS that abandons the petition.

FAQ: OPT to H-1B timeline

Can I register for H-1B while still in school, before OPT starts?
Only if an employer registers you and you will be eligible to change status or consular process as planned. Most students register in the March during OPT. Eligibility is fact-specific; the employer’s attorney should confirm.

Does a master’s give me extra OPT?
A new degree at a higher level can give a new 12-month OPT. A second bachelor’s does not reset the same way. STEM is about the CIP code of the degree you are using, not the word “master’s.”

If I win the lottery in March, can I start H-1B in April?
Not for a normal cap-subject “new employment” petition. The start is October 1. Cap-gap is what covers late summer.

Can I switch employers on OPT before H-1B is filed?
Often yes on OPT/STEM OPT if you follow DSO reporting and I-983 rules. The new employer must be the one who registers/files. An H-1B filed by employer A does not let you work for employer B.

What if my OPT EAD is delayed and I miss the start date on the I-20?
You cannot work until the EAD is in hand (and valid). Ask your DSO immediately; do not start work “because the offer letter says so.”

Is premium processing worth it?
It can reduce I-129 anxiety and help travel planning after approval. It does not change October 1 and does not fix a weak specialty-occupation case.

Where do I verify dates?
